Independence Auto seeks rezoning for used car sale location within city - cleveland.com

INDEPENDENCE, Ohio—Independence Auto, a company that specializes in used car and truck sales as well as local car detailing, is requesting a rezoning of property in the city to allow for their services.

The company has a tentative lease agreement with the current owner of the building at 8600 E. Pleasant Valley Rd. According to a presentation from Independence Auto owner Charles Ipsaro, the building is 6,000 sq. ft. and will house used cars and trucks.

The current zoning for the building is U-5A Light Manufacturing, and the company came to the city Planning Commission to ask for a change in zoning to allow for car sales.

During a public hearing on May 4, Ipsaro explained he is seeking a special conditional use permit to operate a used car dealership within the building, which is owned by Quasar. In his presentation, Ipsaro showed documentation stating, “The building is completely sectioned off from another company West of the building. The building has a lock, as well as a door separating the two buildings entirely.”

There would be 15 to 20 cars stored inside the building for sale, which would be sold over the internet with advertising being online as well. Ipsaro wrote in his presentation, “With the shift in the economy, we plan to utilize e-commerce going forward with our business.”

The cars would be kept indoors, and local car detailing services would also be completed indoors. When detailing work was performed, Ipsaro said the company would shuttle people back to their homes when they dropped off their car for that service.

Independence Law Director Greg O’Brien recommended that cars should not be kept outside during any period of time, though he said ultimately it is up to the Planning Commissions and the Board of Zoning Appeals.

O’Brien also referenced the city codified ordinances during the public hearing which states, “Used automobile sales are permitted only if the same are accessory and immediately adjacent to buildings used for the sale of new motor vehicles.”

Ipsaro must obtain a variance from the Board of Zoning Appeals in order to overrule this limitation. Independence Auto has recently received their State of Ohio Certificate from the Secretary of State to approve their name and have taken the required course for obtaining a dealer license. Their next step is to obtain proper zoning and the Planning Commission will continue their discussion about the dealership at a meeting on June 1 at 5:30 p.m.
